I don't understand how you can fail to even arrest the guy in the first place. That says to me self-defense laws are way too strong.
In the case I observed (and in which everyone concerned was black*), a man was arrested after defending himself, his family, and his home against a man who was not legally allowed to be anywhere near the place after previous assaults on people there, a man who showed up and indicated that he had a gun and threatened to shoot everyone. My dad (his lawyer, who has been a public defender for 25 years or so) stated that it was the most favourable police report towards a client he had EVER seen. But they still arrested him and they still charged him. The case even still went to trial.
*Except, y'know, the judge, one of the lawyers, and most of the jury.
